Despite numerous interpretive efforts, the concept remains unresolved, both conceptually and in terms of its normative foundation. Siyuan Zhou is the first to offer a strictly liberal, autonomy-based account of this doctrine, grounding it in the foundational principle of private autonomy in German private law, which, in his interpretation, is ultimately rooted in the Kantian idea of equal freedom.
