Art. 9 para. 3 Aarhus Convention in Conjunction with Art. 47 Charter of Fundamental Rights of the European Union as a Solution for Individual Applicants?': The study examines if and why individual applicants should be able to access courts to address climate change issues. While Art. 9(3) Aarhus Convention and Art. 47 of the EU Charter of Fundamental Rights provide broad access, the German Climate Protection Act (KSG), section 4(1) sentence 6, excludes subjective climate change rights. The study shows that individual climate change protection exists at all levels and that section 4(1) sentence 6 KSG is incompatible with EU and international law.
