'Proposal for Distinguishing Between Factual Error and Error of Law Based on the Principle of Democracy': This thesis deals with the criminal law and democratic theory foundations of the legal treatment of factual and legal errors. Based on these findings, a proposal is developed for interpreting the concept of intent and the provisions on error in Sections 16 and 17 of the German Criminal Code (StGB) and Section 11 of the German Administrative Offenses Act (OWiG). It argues for a major shift in the classification of errors within the scope of application of Section 17 StGB and 11(2) OWiG.
